Many Americans believe that if the Federal Communications Commission (FCC) makes a statement that something technology related is true, they can be trusted with their word, and are the foremost authority regarding the safe and appropriate use of radiation-emitting wireless devices. The actual truth is that the FCC is under a lot of pressure right now to prove what they claim regarding the safety of radiofrequency (RF) radiation, as much evidence the contrary is amassing rapidly.
We have been closely following a court case and lawsuit against the FCC that started almost four years ago that will have profound implications in protecting the health of people, animals and the environment from harmful and excessive wireless electromagnetic field exposure. The last piece of big news was in August of 2021, when the U.S. Court of Appeals ruled against the FCC, determining that they have not adequately considered the health and environmental effects of RF radiation when reviewing (and deciding not to update) their official safety guidelines. The verdict of this case put the ball back in the FCC’s court, requiring that they acknowledge and respond to ALL the current studies about RF harm to living organisms, and to change their guidelines accordingly.

It has been over one and a half years since the FCC was tasked with either providing substantial evidence that supports their decision not to update their guidelines (which doesn’t exist), or to go to work on changing their guidelines to actually reflect not just increased modern exposure levels, but also non-thermal effects.
Guess what they have done since then? Literally nothing, and none of us are surprised.
Just as we predicted in 2021, their plan of action is to delay their responsibility as much as they can possibly get away with. The only alternative would be to change their guidelines, or provide evidence that supports their initial decision not to change them. Changing guidelines would be highly problematic to the telecommunications infrastructure, making it very clear how much they side with the telecoms and not the American people. Providing truly adequate and thorough evidence supporting their previous guidelines (established in 1996, when barely anyone had a cell phone) is impossible, which leaves them with their one remaining tactic: avoidance and delay.
The Children’s Health Defense (CHD) and Environmental Health Trust (EHT), the plaintiffs in this lawsuit, know the FCC’s delay tactics well. After giving them a reasonable period of time to perform their court-ordered duty, the plaintiffs filed a new petition to open the case back up, rekindling the pressure on the FCC.
CHD’s petition stated, “The Commission cannot just sit on this matter any longer… Any continued non-action will violate the judgment and mandate and expose the Commission to further judicial review and, ultimately, a mandamus order requiring action.”
A mandamus is an order from a court (like the U.S. Court of Appeals) to an inferior government official or agency (like the FCC) ordering the government official or body to properly fulfill their official duties, or correct an abuse of discretion. It is when the decision of a higher government authority overrides, and requires specific action from, a lesser government body.
FCC also being pressured by looming September deadline from environmental agency
This lawsuit and the court ruling is not the only fire compelling the FCC into action. The Council on Environmental Equality (CEQ) is the federal agency responsible for determining the rules and legalities of the National Environmental Protection Act (NEPA). The CEQ has issued a set of revisions to the Protection of the Environment rules that require the FCC to consult with them regarding the environmental impact of RF radiation.
CHD attorney Scott McCullough explains, “The FCC’s emission rules [about RF radiation] have always been purely about human exposure. They do not address limits for exposure to birds, bees, trees, etc… But the CEQ rules — which they have to update to match — make plain that NEPA procedures are all about [the] impact to the entire human environment, not just humans. The science is telling us RF is harming not only people but also wildlife, trees and especially pollinators.”
With two government agencies both requiring updated safety guidelines from the FCC, from two different angles, some kind of action is going to have to be taken on their part. We are very curious to observe their next move, as they cannot ignore and dismiss the mounting evidence of harm for much longer. Their time is running out!

Is Robert F. Kennedy, Jr. running for U.S. President?
You may have heard the rumor, and the rumor is true… Robert F. Kennedy, Jr., founder of Children’s Health Defense, has taken the first steps to run for President of the United States in 2024. He will be running as a Democratic candidate, against Joe Biden. As the nephew of U.S. President John F. Kennedy and U.S. Senator Ted Kennedy, and the son of U.S. Senator Robert F. Kennedy, this path is right up his alley.
He has been considering running for President in 2024 for a while now, but just last Wednesday, April 4th, Kennedy filed the requisite paperwork with the Federal Election Commission.
For his campaign, Kennedy states, “My top priority is to end the corrupt merger between state and corporate power that has ruined our economy, shattered the middle class, polluted our landscapes and waters, poisoned our children and robbed us of our values and freedom.”
Kennedy founded CHD after being approached by countless numbers of parents concerned about the alarming rise in childhood chronic diseases, who urged him to look beyond the narratives of mainstream media and government agencies to find the true root causes of this tragic phenomenon.
He explains further, “After carefully reviewing the science, it was clear to me that vaccines and other toxic environmental exposures were inextricably linked to rising rates of autism, allergies, autoimmune disorders and a host of other conditions. I knew I could never turn my back on the children and families so profoundly affected by these exposures. We are not endorsing any Presidential candidate, but we think it's great that he's running, as his campaign for the next year and a half will inevitably result in a widespread dissemination of information and awareness about the harms of wireless radiation, as well as other pervasive toxic exposures that are slowly degrading the health of all Americans, currently unbeknownst to the vast majority of them.
